Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the CompAgent comparable-market-analysis service (the “Service”) operated by CompAgent, Inc. (“we”, “us”). By creating an account or using the Service you agree to these Terms. Your agreement is with CompAgent, Inc.; CompAgent is the name under which the Service is offered.

1. Who may use the Service

The Service is intended for licensed real-estate professionals. You represent that the information you provide about your license and brokerage is accurate, and that you will use the Service in compliance with all laws and the rules of your licensing authority and any MLS or association you belong to.

2. The Service is a decision-support tool, not an appraisal

The Service produces automated valuation model (AVM) estimates, comparable listings, and AI-generated commentary. These outputs are estimates for informational purposes only. They are not appraisals, are not prepared by a licensed or certified appraiser, and do not comply with USPAP. They must not be represented to any client or third party as an appraisal or as a guaranteed value. You are solely responsible for the pricing advice you give and for independently verifying any figure before relying on it. See our Valuation Disclaimer.

3. Accounts and security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at info@compagent.io of any unauthorized use.

4. Subscriptions, billing, and reports

Paid plans are billed monthly in advance through our payment processor, Stripe. Plans include a monthly allotment of reports; usage is metered per account. Fees are stated on our pricing page and may change on notice. See our Cancellation & Refund Policy for cancellation and refund terms.

5. Third-party data

Property and market data are supplied by third-party providers. We do not warrant that such data is complete, current, or accurate, and we are not responsible for provider errors or omissions. Imagery may be supplied by mapping providers subject to their own terms.

6. Acceptable use

You agree not to resell or redistribute the raw data feeds, reverse-engineer the Service, use it to build a competing dataset, or upload unlawful content or another person’s information without a lawful basis to do so.

7. Intellectual property

We own the Service and its software. You own the reports you generate and the notes and client information you enter, and you grant us a limited license to process that content solely to provide the Service.

8. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, AND WE WILL NOT BE LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS OR LOSSES ARISING FROM PRICING DECISIONS.

9. Termination

You may cancel at any time. We may suspend or terminate accounts that violate these Terms.

10. Governing law & changes

These Terms are governed by the laws of the State of Delaware, USA. We may update these Terms; material changes will be communicated through the Service or by email, and continued use after the effective date constitutes acceptance.
